ELIGIBILITY
This contest is open to all residents of mainland UK and Ireland. Do not proceed to enter if you are not at least eighteen (18) years of age and a legal resident of, and located within, mainland UK and Ireland at the time of entry. Employees of the Sponsor, its affiliates, subsidiaries, advertising and promotional agencies, and their family members (spouse, parents, children and siblings and their spouses) and individuals living in the same household of such employees are ineligible. All national and local laws and regulations apply. Void outside of mainland UK and Ireland and where prohibited. The Sponsor may report, as required by applicable statute or regulation, the value of the prizes and the identity of the winners, to appropriate taxing authorities.

CONTEST PERIOD
The Balsam Hill UK’s 2nd Annual Trim The Tree Photo Contest ("Contest") entry submission begins at 11.00am GMT on 29 November 2017 and ends at 11.59pm GMT on 22 December 2017 ("Contest Period"). Voting begins at 12.00nn GMT on 23 December 2017 and ends at 11.59pm GMT on 1 January 2018 ("Voting Period"). The Sponsor’s computer is the official timekeeping device for the Contest. Entries received beyond the Contest Period will be void.

Winner announcement will be published on the Balsam Hill UK Facebook Page on or about 06.00pm on 2 January 2018.

HOW TO ENTER
The Contest will use “Easypromos” as its Official Contest App. Contest is hosted on: http://bit.ly/TrimtheTreeContest

Before entering the contest, you must ensure that your Instagram or Twitter account is set to public. During the Submission Period, you must follow @BalsamHillUK on Instagram (https://www.instagram.com/balsamhilluk) or Twitter (https://twitter.com/balsamhilluk). Submit a photo of your decorated Balsam Hill UK Christmas Tree via the official contest app or upload directly on your Instagram or Twitter account with the hashtag #BHUKTrimtheTree. Tag @balsamhilluk and write a short description on how you decorated your Balsam Hill UK Christmas tree. Photos must be uploaded in accordance with the Instagram (http://instagram.com/about/legal/terms/) and Twitter (https://twitter.com/en/tos) Terms of Use.

Each uploaded photo will be counted as one (1) “Entry” and is subject to the requirements outlined in the Official Rules. Multiple entries from one e-mail address or Instagram/Twitter account are allowed provided that each entry in UNIQUE. Participants can only win once. All Entries must be complete and received before the end of the Submission Period to be eligible for voting. Entries may only be submitted by a single registered Instagram or Twitter user. When entering using the official contest app, you need to provide your full name and email address. Each participant in the Contest must be the rightful owner or have authorized use of the e-mail account indicated by the participant’s e-mail address. In the event of a dispute concerning the identity of the winner submitting an entry, the winner will be deemed to be the person in whose name the e-mail account is opened. The e-mail account must be opened prior to the commencement of the Contest.

Group submissions are not permissible. Multiple entrants are not permitted to share the same device, Instagram/Twitter account or email address. Use of computer programs and/or other automated devices to enter the Contest is prohibited. Normal Internet access and device usage charges imposed by your on-line service will apply.

Only photos of Balsam Hill UK Christmas trees are accepted. Submitted photos must be no larger than 3 MB. Photos that include any visible signatures, watermarks or credentials (name, address, etc.) will not be considered for the Contest.

In submitting your photo, you confirm that: (a) You are its sole author and owner of the copyright; (b) You have the right to give Balsam Hill UK permission to use your photo for the purposes specified in these rules; (c) You have the consent of anyone who is identifiable in your photo or the consent of their parent/guardian if they are minors; (d) Your photo does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If you do not own any materials contained in your photo, you are responsible for obtaining, prior to submission of the photo, any and all releases and consents necessary to permit the use of the photo.

There is no cost to register or enter. No automated entry devices, bots and/or other programs and/or software are permitted for entry. All entries become the property of Balsam Hill UK and will not be returned.

WINNER SELECTION/DRAWING
Starting 23 December 2017 to 1 January 2018, Facebook users can vote for their favourite Balsam Hill UK Christmas tree photo. All participants in the contest are allowed to share their photo entries to spread the word about the contest and encourage friends and families to vote for their entries, via our Official Contest App. Users may Like the Balsam Hill UK Fan Page before they vote.

The top twelve (12) photos with the most number of votes by 1 January 2018 will be judged by the Sponsor based on the following criteria: 30% creativity, 30% uniqueness of concept, 20% entry description, and 20% photo quality. The Sponsor will select three (3) photos and determine the ranking in its sole discretion, and such determination will be final and binding. Winners will be announced on or before 2 January 2018.

WINNER NOTIFICATION
Potential winners will be notified via Facebook announcement and private message or e-mail and will be required to complete and return a Certificate of Eligibility within seven (7) days of date of notification or alternate winners may be selected from valid entries received. If the winner fails to return the required document within the specified time period, cannot be contacted, is ineligible, has been disqualified, fails to respond or claim the prize within seven (7) days from the time award notification is sent, or where the prize or prize notification returned as undeliverable, the prize will be forfeited and, at the Sponsor’s discretion, an alternate winner may be selected.

The Sponsor shall have no liability for the winner’s failure to receive notices due to spam, junk e-mail or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information.

PRIZES

• To one (1) grand prize winner, Balsam Hill UK will award one (1) Balsam Hill UK shopping spree in the amount of £150.00 GBP.
• To one (1) second place winner, Balsam Hill UK will award one (1) Balsam Hill UK shopping spree in the amount of £100.00 GBP.
• To one (1) third place winner, Balsam Hill UK will award one (1) Balsam Hill UK shopping spree in the amount of £75.00 GBP.

Total value of all prizes shall not exceed £325.00 GBP. Prizes are awarded "as is" with no warranty or guarantee, either expressed or implied by the Sponsor.

Winners may not substitute, assign or transfer prize or redeem prize for cash, but the Sponsor reserves the right, at its sole discretion, to substitute prizes (or portion thereof) with one of comparable or greater value. Winners are solely responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. RIGHTS GRANTED
Except where prohibited, You understand and agree that Your participation in the Contest constitutes Your consent to the Sponsor’s, and its agents’ right to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and worldwide, without limitation, Your entry, name, picture, likeness, image, statements about the Contest, and biographical information for news, publicity, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent.

Copyright in all images submitted for this competition remains with the respective entrants. The Sponsor is not responsible for comments or negativity regarding photos posted on the Balsam Hill UK Facebook, Twitter or Instagram page or in other venues. Any abusive activity perpetrated by any contestant, their family, friends and/or associates may in the sole discretion of Balsam Hill UK, be removed and disqualified from the contest. Balsam Hill UK reserves the right to disqualify any participants should there be any submission of cheating.

By entering, You agree that the Sponsor and its affiliates, agents and promotion agencies, as well as Facebook, shall not be liable for any and all losses, damages, rights, claims, and actions of any kind in connection with the Contest or resulting from the winner's participation in the Contest, acceptance, possession, use, or misuse, of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, privacy or defamation.
